On the contrary Diego, and to set the record straight, the EULA and
modifications were written by our legal counsel, a reputable firm with extensive
experience in GPL/LGPL issues. Let me assure you this is a good faith effort to
correct the issues.

The restrictions section you refer to (Section 3), refers to the "Cooliris
Software" which is now written in Section 1 to specifically exclude Open Source
Software.

I've highlighted the exclusion below as it appears in our EULA:

"Notwithstanding the forgoing, the Cooliris Software includes certain open
source software ("Open Source Software") whose different license terms are
described in this paragraph. Portions of this software are based in part on the
Freetype library, a work of the Freetype team and licensed under the Freetype
License. Portions of this software (FFmpeg) copyright (c) 2000 - 2008 Fabrice
Bellard et al. are licensed under the LGPL 2.1. Original source for the FFmpeg
library is available here. Portions of this software (Protocol Buffers)
copyright (c) 2008 Google Inc. are licensed under the Apache License 2.0.
Portions of this software (dcraw.c) copyright (c) 1997-2009 Dave Coffin are
licensed for redistribution without RESTRICTED functions under "option c" of
dcdraw distribution agreement."
