Pasalnya, peraturan baru kawasan berbayar (electronic road pricing)-- yang akan mengantikan peraturan 3 in 1, juga akan diberlakukan untuk kendaraan roda dua. Kementerian Perhubungan dan Dewan Perwakilan Rakyat (DPR) sudah membuat undang-undang soal ini. Apakah nanti diterapkan atau tidak, sangat bergantung kepada pemerintah daerah. "Pemerintah kota dapat mengambil restrubusi. Itu sudah dibuat peraturannya," ujar Kepala Pusat Komunikasi Kementerian Perhubungan, Bambang S Ervan, Senin 10 Mei 2010, saat dihubungi VIVAnews. Menurutnya, setiap kota yang memenuhi kriteria tertentu dimungkinkan untuk mengambil restribusi sesuai dengan UU No 22 tahun 2009. Berapa jumlah retribusi itu. "Angkanya belum tahu dan masih dalam pembahasan," ujarnya. Uang dari retribusi itu akan digunakan untuk perawatan jalan dan sekaligus bisa membatasi pengunaan kendaraan. Artinya dengan beban biaya itu diharapkan orang akan menumpang kendaraan umum. Fasilitas kendaraan umum diperbaiki dari uang retribusi itu. Sebagaimana luas diberitakan bahwa Kementerian Perhubungan segera mengganti peraturan 3 in 1 menjadi kawasan electronic road pricing atau ERP. Dalam kebijakan yang baru nanti, setiap kendaraan umum yang akan melintas di kawasan berpenumpang tiga orang atau lebih, akan dikenakan retribusi. Pengendara mobil direncanakan akan dikenai retribusi sekitar Rp 20.000. Di Jakarta, sejumlah ruas jalan yang masuk peraturan itu antara lain Jalan Sisingamangaraja, Jenderal Sudirman, Thamrin, Medan Merdeka Barat, Majapahit, Gajah Mada, Pintu Besar Selatan, Pintu Besar Utara, Hayam Wuruk, sebagian wilayah Gatot Subroto dan Rasuna Said. Untuk memudahkan jalannya pungutan retribusi, pemerintah akan membangun pintu gerbang di setiap mulut jalan-jalan itu. Pintu gerbang ini akan dilengkapi teknologi OBU (on board unit). Data yang dimiliki Dinas Perhubungan DKI Jakarta menunjukkan bahwa peningkatan jumlah kendaraan pribadi sangat pesat. Mencapai 1.117 per hari atau sekitar 9 persen per tahun. Peningkatan yang terjadi saat ini tidak diimbangi dengan pertumbuhan luas jalan. Pertumbuhan jalan relatif tetap, yakni sekitar 0,01 persen per tahun. Jka pembenahan pola transportasi tidak dilakukan, maka pada 2014 Jakarta diperkirakan macet total.
