I would say not as model releases and OS releases do not coinside and I have bought a Mac that was previously available with one OS version after the new version was released so that I would get the latest release "for free".

That's true. It is possible that a later version of a machine would have had the later OS, but since James doesn't have any idea which OS came with the computers, the safest (legal) thing to do would be to go with the earliest OS the machine is capable of running.

Of course, he should also take any free upgrades or updates for that version.
