That is pretty much what happened. Here is the scoop on James North's 
plans to refund orders as I know it.
Back in late 2005 and early 2006 James North was getting sick and tired 
of being hounded about Monte and Raceway so he said he would refund 
everyones orders, delete the games, unless someone else would take them 
over and finish them. Either way he was baling out of the accessible 
games business.
The nice guy that I am, perhaps too nice for my own good, decided to 
take over these games, complete them, and release them under USA Games. 
James was suppose to refund the customers since he no longer held 
copyrights for the games, but never did. Instead he held onto the money 
claming it was money owed to him to buy him out of the copyrights for 
Monte and Raceway. I never argued with him, but decided I'd simply try 
and give copies to the Alchemy pre-ordered customers rather than fight 
with him over who had a right to the money gathered in pre-orders.
For my single act of good will for the accessible games comunity I got 
my share of being cussed out, chewed out, called names I shall not 
repete, threats of law suits, because I really was in no financial 
position to give anyone their refunds which James North had the money 
for. I certainly didn't deserve that sort of treatment, but that didn't 
seam to matter to some of the  people in our comunity. It took a titanic 
act of will not to email each and everyone of them back and tell them to 
bend over and where to put that pre-order money. Following that I could 
tell them where they could go. However, because I no saying those things 
wouldn't do anyone any good I tried to be civil with everyone of them 
through that rough transition. all of them shut up after I released Beta 
1 and now they got their keys they are happy as clams.
