So, 1) and 2) from your original email are completely separate issues? If so, I was confused and thought they were related somehow. You've definitely got a kernel bug there. Have you searched to see if anyone else has experienced this problem? Like Patrick said in the first reply, you might need to pursue this one upstream with the kernel developers.
