Chritopher, As others have pointed out this is somewhat a grey area, however I would state that as a general principal if you create a feature that does not feature on the map view in maps or on one of the layers in earth, so you are not copying an existing feature, then the new feature is your creation, Google will not make claim over it's ownership.
