There are two ways of looking at this. The cracker is a criminal, pure
and simple. The admin being stupid does not absolve the cracker from
their crimes. The admin isn't a criminal. On the other hand, a company
would be justified in taking action against an admin. The admin did
not do their job, and therefore, they should be shot on sight ;-)

Why not? It *IS* their fault. If they didn't patch the hole, they they
are guilty of negligence. Legally, it isn't your fault, but as far as
the comapny is concerned, it is. They were supposed to protect the
network, and they didn't.

Ah, the perfect analogy. If you leave your door open, and I take your
TV, I can be charged with theft, but not breaking and entering. Also,
if you go out, and you are the last one out the door, and you leave it
open, then someone steals your TV, who is your *WIFE* going to blame??
She's going to yell at you for leaving the door open.
