Well, in the case of the Dehydrate Spell, if you touch the person, then you dehydrate that body part; otherwise, you affect the entire body. Being able to to touch the person would increase the likelihood of crippling a body part or result in significant better damage modifiers (e.g. head attack).

I do see your point; however, I do think the rules as written indicate that both touching or being within a yard are non-penalized uses of a Regular Spell.
