Actually, no, they can't. We have underlying programming we can't overwrite any more than a computer can. It's just more complicated.
The real question, however, is to what degree creativity actually matters in air to air. There are plenty of situations where computers have been unbeatable for decades, and in many cases even when the computer can still be beaten by the human grandmaster, it will beat the hell out of the average person.
