Exactly, Stefan. If the CD-KEY IN USE error message comes up, it's because Valve's received the communication, looked it up, and given it the thumbs-down. If it's coming from the same IP, then don't worry about it. If it's coming from different IP's, reject that CD-Key for a week. The next time it's triggered, ban them forever.
So when someones PC crashes, they reconnect, with a new IP, and get this error, they should be banned??
