These people distribute valves copyrighted content, and this is illegal, according to the EULA. If by breaking the EULA you mean Tom�s's no-won patch and paragraph (3) of the EULA, I disagree, as there are laws which grant you to do the things mentioned in that paragraph, no matter what your license agreements with the copyright holder say. This might not be true for the USA, but they're not known for liberal handling of several civil rights for some time now...
