On the face of things (and by that I mean arguments in the press from Apple Corps' lawyers) it does look as though Apple Computer purposely broke their agreement. However, as was pointed out by another poster, we don't know what was in the agreement. And I for one just cannot believe Apple Computer would be stupid enough to launch iTunes without knowing this would happen and being prepared for it one way or another.
Just my two cents on the matter.
