The fact remains that *according to published accounts* Apple has *reportedly* paid nearly $30 million USD in settlements to Apple Records for violation of these agreements. It's my guess that they feel they'll profit enough in the long run to justify the expenditure.

Assuming they did, in fact, violate the agreement. Everyone is simply assuming they did, they must have Oh, of course they did, etc. But all the people making these assumptions do NOT know what is in the agreement at all, since the agreement is confidential. Without knowing the EXACT wording of the agreement, no one should be saying that Apple violated the terms.
