I cannot find the case (I will keep looking), but it did not hold up in court. When the FAX law was passed, fax machines were just becoming popular. The offices of Congress were getting flooded with faxes, costing a bundle in paper. The law was rushed through and now regretted on capital hill. The primary reason it is taking so long to get an anti Spam bill passed, is they do not want to make the apparent mistake they made with the FAX law. Large corps are afraid they may be cut off from a future form of profit... and the DMA is spending a bundle to muddle the issue. The problem I see is no Spammer will send Spam to a .gov domain... they have no idea how bad the problem really is!
