Careful now. I don't think it was McAfee's intent to "..attempt to violate..." Hormel's trademark.
Perhaps that wasn't their primary reason for capitalizing it (perhaps the marketing folks wanted it that way?). But any company that has been in the anti-spam business for any reasonable length of time knows that "SPAM" is a trademark of Hormel, and that they are quite kind and don't mind the term "spam" being used to describe unwanted E-mail, but that they do not appreciate unwanted E-mail being referred to as "SPAM".
Given McAfee's cluelessness, though, it was likely an oversight. Remember, they are the ones that somehow didn't take a couple minutes of time to include the IP address in the Received: header, making McAfee servers a very welcome treat for spammers. Or perhaps I should say SPAMmers?
FWIW, I believe the *only* reason that people ever use the all-caps version to refer to unwanted E-mail is because Hormel's trademark is in all caps. For example, you never see people saying "I deleted that E-mail with a VIRUS that someone sent me, since I do not want to be infected by a VIRUS."
