Yes, the FSF releases code in GCC. It doesn't pass the TCK. But
according to the process, they absolutely do not have the rights to
any of the copyrights, trade secrets or patents within the Java SE
platform spec. (And that IP isn't just from Sun, it could be from any
member of the Java SE JSR expert group).

You need to ask the FSF as to why they believe they have the rights to
do what they do.
