Right, that hardware menu button went away a long time ago. I have both a samsung 10.1 tab (~2012) and their 12.2 note tablet. Neither has the hardware menu button, and both have the K-9 provided 3 (vertical) dots menu option instead (as is the case with all my other apps).
It's possible that for some reason K-9 *thinks* you have the hardware menu so isn't showing it in software. Is the app-provided menu missing from other apps? You might try the MW-Pen App Enabler app that I suggested, it might tell K-9 something different about the device/screen so you might get that menu button back.
