Anna,

The key word being "LAST"; the "last" right - as in "last while
alive", only to be EXECUTED after death. Synonym = "last wishes".

You just said a person is an entity with a living brain. How does
this position mesh with that one?

If what you say would be the truth, then the LAST WILL would be
worthless the moment a person dies. Since the dead person's
wishes must be executed as written, it means that the dead
person still has certain legal rights, even after the demise.
Such right is for example to have his LAST WILL enforced as
directed.

Socialism/Capitalism of the A

When a person dies, his assets will soon be transferred
precisely
because he can no longer own them. I feel so foolish explaining
  such basics.
