Libertarians are NOT necessarily constitutionalists.  Many libertarians
consider the US Constitution to be a repudiation of the Declaration of
Independence, which IS a (divinely inspired??) libertarian document.

Many of us consider the US Constitution to be our contract with our
government.  When our government fails to live up to it's end of the
contract, though, it becomes null and void.

Keep in mind that the US is on it's second constitution.  The first was "The
Articles of Confederation".  It did have it's faults, primarily that it
didn't give warmongers and powermongers what they wanted.

Most of us don't have a problem arguing the constitutionality of any
particular issue.  But whether something is "Constitutional" or
"Libertarian" can easily be two different things.
