It works for the BSA for "corporate piracy" (more like bad book keeping, but a buck is a buck, right?). If the license for the software says that the company must license based on a zAAP and the company does not reveal that it is using a zAAP, then a lawsuit (or threat of one) will ensue. Most companies (I hope) are honest enough to abide by the contracts that they signed for the software they run. Most mainframe software companies are contributing to its demise due to their asinine (IMO) way of charging for "upgrade fees". We are in desperate need of a CPU upgrade here. But the vendor would want 1.6 million US dollars IMMEDIATELY to upgrade the licenses. Why? I won't debate the increase in monthly fees, but why an "upgrade" fee? Are the vendors doing anything? NO! We're running exactly the same software. They're just fat, dumb, and greedy. And they can get away with it. At least until the last mainframe (or at least z/OS) dies for this short-sighted piggishness. Luckily, Microsoft has learned of this and are starting down that path as well. This just about guarantees their death as more people say: "That's just plain dumb and stupid!
