Because it's in the license agreement that someone at your company signed. That's where you should seek the blame, not the ISV. If there's a charge agreed in that license, they can't waive it because that conflicts with their duty to their stockholders. The exact same situation applies in the Linux world. Although Linux itself is "free", any applications you purchase from an ISV will also come with a license agreement - and it may not be much different to the mainframe one you currently have.
