je ne suis pas daccord avec le point 2: la propriete intelectuelle pour le soft ne va pas *necessairement* contre l'opensource. Si kkun invente kkchose de nouveau c'est normal qu'il puisse garantir et garder invention et donc l'investissement. Se qui est bien negatif se sont les derives du system de patent et ca c'est un probleme pour l'opensource (on patent n'importe quoi). Si kkun invente je ne sais quel systeme pour faire une operation plus rapidement ou kkchose comme ca (un bon exemple c'est l'update du checksum ip/tcp/udp quand on fait du nat, ils y a une technique qui permet de ne pas recalculer tout le cheksum quand on change une addresse, ca ca pourrait (ou est meme deja je pense) patente. Cela n'empeche en rien les gens de faire des boites a nat sans ce systeme la).
Attention, cela se passe partout ces influences meme au sein de l'ietf qui devrait un organe de standards sans influence/appartenance a un vendeur particulier cela n'est evidemment qu'un voeux pieux. Rien que pour ipsec, pratiquement tous les RFC's/drafts se voient entaches de techniques qui sont sous la couverture d'une patent kkonque (et aller savoir exactement se qui est patente au niveau technique est un chemin long et penible, vraiment).
