Are you sure? I find myself often debating this sort of issue.
(X)Html, and all its related standards, are about marking a document,
not a site, that's why, for instance, we can't repeat an Id on the
same page, but it does get repeated across the site.

When tagging a homepage, a collection of samples from its sections, as
homepages often are, I think H1 should mark the site's name, but once
on a section maybe the section name could/should be the H1. I don't
think tagging a subsection as H3 on one page should mean that that
subsection will always be marked as an H3; in fact I know it
shouldn't, if you do not mention the section(e.g. H2) on the document
you should not tag the subsection as H3.
HTML marks documents not sites.
