I would suggest it's worth going back to Apple or Best Buy and trying again. 
I'd forgotten about the constantly running speaker issues you were having, so 
thanks for pointing them out again! :) I haven't noticed this issue with my 
iPad or my Dad's which leads me to suspect something going on with your 
particular unit.  When I'm in settings I am able to swipe and have the iPad 
recognize the gesture correctly.  
I hope you are able to return the iPad or get a new unit! Good luck!
