Actually, there was a mechanism in place when I worked there that would refuse
traffic from an IP if 
 (a) no traffic had ever been received from it; and 
 (b) there had been signifcant spam traffic from other IPs in that /24 at some
time.  

I handled four or five delist requests for that BL per week.  Whether that is
still in place many years later, I can only speculate.  The logic for
implementing such a mechanism is weak, but the cost of removing it might be
significant.
