We have this concern at our institution as well.  We dealt with it, at
least for the short term, by making it clear that the lecture is being
recorded, what is being recorded (this side of the room, etc) and when
it is being recorded.  We have no encountered any issues so far.  We are
also working on a hardware solution which would indicate not only the
status of the recording, but also the audio levels.  This hardware is
still very much in the design stage however.

Speaking as a developer on the capture team, this is far easier said
than done.  It is obviously possible, but unfortunately the current
feature roadmap places this functionality far into the future.
