well, are you going to complain if a driver for a peripheral that is
_absent_ on a specific system is not shipped with it?

I can understand if we talk about plug'n'play peripherals or packet
filtering code, but many SoC drivers are specific to the SoC they ship with.

and replying to myself to fix the answer - meaning adding the non kernel portion - the ospm is not needed on OMAP
why would we include it?
