Like their ragings against "PC" and "taxation", it is simply a strawman set up to demonize the "enemy" (in this case, those horrible "libs").
As I said in previous posts, the "market" has no bones about the buying and selling of human slaves, of distribution heroin or child pornography. In contexts where certain groups of people are considered "property", the "market" has no qualms whatsoever about offering them as merchandise. Even "copyright" is a regulation on the "market", by restricting the goods that I can bring and sell based on whether or not the "State" recognizes the intellectual ownership behind its production to someone else. Another example would be the buying and selling of poisonous animals, which is, in fact, regulated. Taken to an extreme, but valid, is the regulations prohibiting the open distribution of WMDs. There is a reason you can't walk into your local gunshop and by a surface-to-air rocket launcher capable of taking down an airplane.
