I think here is no bug, but lame detects silence.
If you want to force lame to use no smaller frame than 128 kbits
you will have to add -F to your command line.
btw I have to correct myself:
-Z enables Takehiro's subblock gain code
you would have to use -q1 to turn that scalefac_scale feature on
for VBR.
So, your command line should look like
lame --vbr-old -V1 -q1 -mj -b128 my.wav my.mp3
or
lame --vbr-old -V1 -q1 -mj -b128 -F my.wav my.mp3
if you want to force lame not to use any frame smaller than 128 kbits.
