So it was illgally used by TOI.

That was not my question.
I want a case where a Profit making LALA kind of business man exploited a
Non-NC work. I guess this in the only worry a person has which provoke him
to use NC clause.

If "Kalyaan Verma" would have used CC-By or CC-by-SA and then imagine TOI
used it for PROFIT then may someone calculate that how much extra money TOI
will get to its revenue just because of Kalyaan Verma's photos.

If Kalyaan Verma want that nobody should get a single paisa with using his
photos then he would have used "ALL Right Reserved, Permission granted only
to see it in this form and copying/saving and doing anything else is not
permitted."
