I sit here scratching my head at that question.

To get every copy of AD, they'd have to seize hundreds of servers, world-wide.

To get every copy of an Exchange mailbox, they'd seize a minimum of 
four-servers, one of which is guaranteed to be in a different data-center. And 
I don't know the logistics of how mailboxes are grouped (on the shared servers) 
I guess that conceivably dozens of servers would be involved.

Like someone else posted - with an operation of that scale, you'd need LOTS of 
U-Hauls! :)

Actually, if you are familiar with the technologies used (and I know you are!), 
the separation is pretty clear (DataCenter Edition of AD is still AD; 
DataCenter Edition of Exchange is still Exchange; DataCenter Edition of Lync is 
still Lync; etc...)..

And yes, bunches of companies would get whacked all at once.

That being said, Office 365 does have some safeguards - there are multiple 
copies of EVERYTHING.

You also have to wonder if a "seizure" for a single instance would affect the 
entire Office 365 cloud, or would they simply give the FBI a single virtual 
instance.  It's also unclear how accounts are separated in Office 365.  Does 
each company get its own virtual instance or is it shared?  I assume it's 
shared, otherwise the energy activists would be all over them for improper 
datacenter consumption.  So, with that in mind, if one company gets whacked, a 
bunch of company's would get whacked at the same time.

No reason to be surprised.   Data Privacy in the US completely favors vendors 
and data holders, rather than data generators/owners.

BTW, this seems like a move by Microsoft to avoid the pain and discomfort of 
seizure.  Easier to say up front that they'll hand it over, so as to avoid a 
larger disruption of services.

I tend to assume that this is so with *all* providers, regardless of whether or 
not they are willing to state it (or, even if they clearly state the opposite)
