Actually, if you are familiar with the technologies used (and I know you are!), the separation is pretty clear (DataCenter Edition of AD is still AD; DataCenter Edition of Exchange is still Exchange; DataCenter Edition of Lync is still Lync; etc.).. You also have to wonder if a "seizure" for a single instance would affect the entire Office 365 cloud, or would they simply give the FBI a single virtual instance. It's also unclear how accounts are separated in Office 365. Does each company get its own virtual instance or is it shared? I assume it's shared, otherwise the energy activists would be all over them for improper datacenter consumption. Data Privacy in the US completely favors vendors and data holders, rather than data generators/owners. BTW, this seems like a move by Microsoft to avoid the pain and discomfort of seizure. Easier to say up front that they'll hand it over, so as to avoid a larger disruption of services.
