You also have to wonder if a "seizure" for a single instance would affect
the entire Office 365 cloud, or would they simply give the FBI a single
virtual instance.  It's also unclear how accounts are separated in Office
365.  Does each company get its own virtual instance or is it shared?  I
assume it's shared, otherwise the energy activists would be all over them
for improper datacenter consumption.  So, with that in mind, if one company
gets whacked, a bunch of company's would get whacked at the same time.

No reason to be surprised.   Data Privacy in the US completely favors
vendors and data holders, rather than data generators/owners.

 

BTW, this seems like a move by Microsoft to avoid the pain and discomfort of
seizure.  Easier to say up front that they'll hand it over, so as to avoid a
larger disruption of services.

 

I tend to assume that this is so with *all* providers, regardless of whether
or not they are willing to state it (or, even if they clearly state the
opposite)
