In the past Wizards has gotten as specific as saying "you can't put the phrase 'Core rulebook' on the cover of your product" because people were doing it. If people are doing it and it goes against what they think is acceptable then they're going to put a lock out on it.

Absolutely. They might look at a product like mine and take steps to strip the d20 logo off of it. But I am not too worried about it. Custom Heroes is very much reliant on d20 Modern to work. I don't think anyone from WotC is going to see it as a threat to selling copies of d20 Modern or the Player's Handbook.
