And you've missed my point. Publish at your own risk but now is the season
to profit from that risk.. the field is sparse and retailers want to sell
these things right now. I think the risk that they may change the license
may be high, but the risk that Ryan or WotC will try to bury Penumbra or the
other published works in legal is low enough that it may be worth taking
that risk.

That's not Ryan's point at all. He's saying be careful because the license
isn't valid and the d20 SRD is not OGC, so material based on it has exactly
the same legal status as a netbook (illegal). Granted, it isn't expected to
stay that way, and there is a gentleman's agreement in place, but it's risky
to bet the farm on a digital handshake.
