Yes it is legal.  The online use policy constitutes a revokable licnse.

A real hair splitting exercise - AND you are incorrect.  The online use 
policy is revokable license that grants the users rights within certain 
boundaries.

The online use policy is no different in this respect.  If someone steals 
your IP or abuses the license, the copyright/trademark holder you can stop 
them through EXACTLY the same legal proceedings that you would use for the 
OGL.

I agree with you - but you should not sell people on a particular idea when 
there is a much better option available for their purposes.
