Basically, the safest bet is simply sticking with the d20 SRD content. The further you go from that (ie: trying to use other developer's content) the trickier it gets. So here is the bottom line: Just use the SRD stuff if you are a fan and then add your own stuff to it. That is the best way to be safe and take advantage of the safe harbor. The "nightmare" downstream liability example only could possibly happen if you used non-SRD content. Avoid that, and you avoid that problem.
