This is true in theory, but the details will nail you to the wall.  You can
create a game based on the ideas in D&D and have nothing to fear.  People do
it all the time.  The trouble comes in when you start taking the details
from D&D and incorporating them into your game.  Some of those details,
taken by themselves, are fair game.  All of those details, taken as a whole,
probably constitute an expression of ideas that deserve protection.  Despite
many claims to the contrary, nobody knows where the line is, which is why
the OGL was created in the first place.
