This is true in theory, but the details will nail you to the wall. You can create a game based on the ideas in D&D and have nothing to fear. People do it all the time. The trouble comes in when you start taking the details from D&D and incorporating them into your game. Some of those details, taken by themselves, are fair game. All of those details, taken as a whole, probably constitute an expression of ideas that deserve protection.
