You completely changed the meaning of Sigil's quote with your cut&paste. He was saying that some publishers have tried designating their OGC by stating "anything specifically derived from the SRD is OGC" (sometimes done as a CYA after other designations). Not only is Sigil right to complain about this, but Ryan has stated that such a method of designating OGC is not acceptable under the terms of the OGL because it does not clearly identify the OGC.
