As soon as it isn't clearly indicated. I know that sounds like a circular argument, but it is impossible to know in advance what 'clearly indicated' means. I have spoken to at least one attorney who believes that the DMCA could be used to prevent unauthorized distribution of encrypted OGC so long as it is otherwise clearly indicated to be OGC. Others may disagree with that assessment.
