Under the d20STL you do yes. He was talking about going it alone where indicating compatibilty is one of the acceptable uses of someone else's trademarks: "Our bags fit Hoover vacuums."
Except that the WotC OGL --not the D20STL-- is where the clause forbidding using trademarks to indicate compatibility or co-adaptability resides. So you'd be blatantly violating a contract if you did that, rather than treading in the gray-but-fairly-well-lit realm of acceptable use of ohters' trademarks.
