Whoze private property? The service provider clearly owns the "email box" on its server. But ICANN has already ruled you can't own a domain name...



2) Explicitly state in law and regulation that selling products and services for resale to third parties who market via spam makes the manufacturer, wholesaler, service provider and transaction processor liable for that spam.

Whoa. Isn't that Restraint of Trade. Manufacturers just don't get to do that, and if they try that type of control, the anti-trust laws kick in. You talking about making an exception for manufacturers? And how would they then control their downstream market? Who would pay to monitor all this?



3) Establish substantial punitive civil fines for email trespass.

Back to the problem of traceability.
