Hi, Len, Well, I must confess, when I read the auction last night, I didn't notice the "all sales final" part. But, I still think it's a very misleading description:
"Overall in Great Condition" Then he mentions a sticky mirror that was supposedly fixed in 1988, and says "I guess that is still the problem". I don't think he can say "all sales final", then mention some problems, say "Overall in Great Condition", and ~not~ mention the biggest, most obvious, and most expensive problem. Collin, even if he knew that "all sales are final", bid on the strength of the description, which was misleading. Such an omission would (if I remember contract law) possibly amount to a "fundamental breach", vitiating the whole contract, including the term "all sales final". If I were Collin, that's the tack I'd take anyway. It was a misleading auction, and he shouldn't get away with it.
