A justice system that does not function correctly, is by definition
unjust.
IMHO one must take a more organic view of things, Tom.
If you look at the notable failures, it is almost always caused by
police/prosecutors ignoring or burying evidence that goes against the case
they are trying to make.
IE: They make a presumption of guilt with regards to the person they have
decided is the bad guy and ignore indications to the contrary.
This is exacerbated by a legal system that rewards people who can afford to
put up a defence.
If the best you can afford is legal aid, you are probably more likely to be
convicted of more serious offences than you are if you can lawyer up with a
high end trial attourney, no matter what your guilt status may be.
If the Crown wants to find you guilty, it has relatively unlimited resources
at it's disposal to do so and will stop at nothing in it's quest.
Add to that, justice is meted out on what can only be described as a very
unlevel playing field where punishments are often all over the map depending
on what part of the map the justice system is located.
In Mr. Shell's situation, I truly think that if he had been tried outside of
Puritan USA, "justice" for him would have looked a whole lot different.
The system isn't so much about justice as it is about winning or losing at
some sort of high priced game of Checkers.
