This is a degenerate case you have set up for purely pedantic purposes. Who releases a GPL'ed piece of code and then says that no one can have it unless at least one person pays for it first? Hilarious. Nor is it entirely clear what it is you're selling in this context. Is it the code? Is it the rights granted by the GPL as applied to your code? Is it the act of transferring? To me, it seems more an act of blackmail than anything else! With the MySQL commercial license, the subject of commerce, i.e. the *thing being defined as commercial* is clear: it is the license that gives the privilege to use MySQL source code in another product without being bound by GPL obligations. No money, no commercial license == no right to use sans GPL obligations. In contrast, there are licenses - like the GPL or MPL - whose rights granted are not predicated on the fact that you have to shell out money for them (the rights) first. Ergo, NON-commercial licenses. So simple a concept any child could understand it.
