To be more precise, software is actually an implementation of
algorithms, which are actually mathematical theorems.  This was the big
controversy behind the patenting of Karmarkar's algorithm, which I
believe was one of the first of them.

How about business method patents?  It's only a short step from there to
software patents, and if I'm not mistaken it was mainly because the
USPTO started accepting these things that opened the door to patents on
software.
