Initiate a chargeback with your credit card provider. They'll credit 
your account while they try to get through to the merchant; when that 
fails it'll be permanent.

I've done this several times with flaky merchants over the past few 
years, and it's worked every time with not too much pain on my end. This 
is with American Express.
