Some time back, there was a lawsuit filed against Lionel and their overseas builder involving copied MTH products. The story I heard was that the settlement of that lawsuit involved MTH getting an interest in the company along with the name, among other things. MTH is currently producing tinplate products using the Lionel Corp name. If you go to MTH's website, you'll see that there is a link on the first page that takes you to their Lionel Tinplate page.
Lionel now operates under the name of Lionel dot com, LLC and not Lionel Corp. Producing a duplicate of a competitor's existing item as a first product is not a logical way for MTH to test the S scale market. More reasonable would be the production of a new item, but probably one they have already done most of the research on in another scale.
