If you must abide by it, and you are responsible for what may happen if you don't, and your rights are determined by it, don't you think you'd better read it before you agree to it? Not reading it and not making an effort to understand it make absolutely no sense to me. The agreement is there for a reason. It was written for a reason. What if a beta of a game messes up your computer? Who is responsible for the damage? Do you know? Hi Shaun, No, but I'm certainly available for questioning if there is something specific you don't understand about the license. As I said my licenses are very understandable as is, and if you don't understand them you can ask about a certain section and I'll try and clarify it in less legal terminology. However, I suspect even if I wrote a license agreement in non-legal terms people would not read it anyway. Its the attitude that its not worth their time to read it more than how it is frazed that is the real issue here. HI Shaun, Well, regardless if you read the End User License Agreement or not once you check the I Agree checkbox and click Next you are legally bound by that license. If you are found violating the license you can be legally sued for breech of license if you get caught breaking the license terms. That's why it is a good idea to at least read the license once to get an idea of what is in it. As far as the readability of the license agreements they really are not that bad. I know I took great care when writing my license to make the terms clear and as understandable as possible while frazing it in legal terms. I think it is the legal lingo that throws most people, but they have to be written that way to stand up in a court of law. Hi Harmony, I resent that comment. As a commercial software developer myself I can say the license agreement is not a piece of junk. It is a legal contract between me and the end users of my product. If they agree to those terms, weather they read it or not, they are legally bound to the contract. It legally protects me and my product from people steeling my ideas, product, intelectual copyrights, etc. Maybe that doesn't matter to you since you aren't the one developing the product, have something to lose by having someone steel your ideas and products, but anyone who creates software for a living do have something to lose. That's why we create these special contracts, the end user license, so everybody knows exactly what the legal terms of use are regarding the software. To explain how we software developers feel about this imagine yourself in a similar situation. Say you have a special hobby like writing stories or you like composing music. One day you write a best selling novel or compose a song good enough to be on the top 10 charts. Now, say some loser without an ounce of talent comes along and writes a book like your best seller and makes millions on your idea, or some disreputable musician takes your top 10 song and performs it without your permission putting himself or herself on the top 10 charts. Wouldn't you be angry, upset, and just a bit ready to sue or take action against the other party for not only using your ideas without your permission but making money off something that belongs to you? That's why contracts and end user license agreements exist. It protects the companies or persons intelectual and physical copyrights to their ideas, products, and so on. True, sometimes copyright owners abuse their legal rights, but over all it works. It helps lay down the legal terms in which the ideas, media, etc may be used. Cheers! is there such thing as a licence translater that will turn licences into english, ie strip the legal junk and make it readable by the average guy, maybe could detect from install programs or be able to translate a licence on screen. Wouldn't you be angry, upset, and just a bit ready to sue or take action against the other party for not only using your ideas without your permission but making money off something that belongs to you? That's why contracts and end user license agreements exist. It protects the companies or persons intelectual and physical copyrights to their ideas, products, and so on. True, sometimes copyright owners abuse their legal rights, but over all it works. It helps lay down the legal terms in which the ideas, media, etc may be used. Cheers! [Audyssey] game installation curiosity
I just installed beta 19 of MOTA, and a thought crossed my mind. Did you notice that the I do not agree radio button was checked by default? I've noticed this during other game installations as well, and wonder why the I agree button isn't the one that is usually checked. Hi Charles, Having I Disagree automatically checked by default is standard installation procedure, and for one very good reason. The main one is that in order to continue with the installation of the software you must implicitly agree to the terms of the license agreement and then are bound by it legally. Basically, from a legal standpoint checking I Agree and then clicking Next is the software equal of signing your name on the dotted line. Its a contract between you and company x, and like all contracts it isn't legally binding until you sign your name on the dotted line, or in this case click the I Agree checkbox implicitly stating your agreement to the contract. In short, its just a legal formality everyone abides by, and the courts will uphold the fact you made a intentional choice to check the I Agree checkbox agreeing to the contract thus making it legally binding in a court of law.
