Dear Madam / Sir, The Bombay Catholic Sabha [BCS] condemns the unwarranted and merciless attack on the US missionaries at Malwani Village, Malad on June 11. It has become a regular norm for communal forces to target Christian groups on the standard pretext excuse that they are indulging in conversion. And then physically attack such groups. We feel the Police authorities have not been fair in handling this sensitive situation. Why only 2 out of the 20 culprits were arrested is a question that needs an answer. We demand that the rest of the miscreants are arrested immediately. Another interesting factor is why the urgency in which the Police produced the accused in the holiday court on Sunday, June 12 and by the evening they were released on bail. Normally in any other situation, the accused would have been in the police custody and produced in the regular Court on the following working day i.e. June 13. We need answers to these type of actions by the Police Authorities. The Chief Minister and the Home Minister should be vigilant enough to ensure that communal forces do not rear their ugly heads to create communal disharmony and create an atmosphere of fear among the minorities. The incident happened late Tuesday, April 5, when supporters of apparently the Hindu nationalist movement Rashtriya Swayamsevak Sangh (RSS), raided the Carmel Convent School in Gwalior, a city in the northern part of Madhya Pradesh, and burnt the effigy of Dr. John Dayal, President of the All India Catholic Union (AICU), Catholic officials said. There were no immediate reports of injuries. The [attackers] also made an attempt to vandalize the school property, but the timely intervention of the local police prevented the... incident, the AICU added in a statement to the BosNewsLife New Delhi Bureau. They held a meeting later in the evening and demanded an apology from the Church for the perceived anti Hindu article and warned Christians that they would extend their agitation to other institutions and schools in the city, the AICU stressed. However the local Hindi newspaper, Dainik Bhaskar, misquoted Dr. John Dayal as saying that the church in India was against the Hindu religion, during an April 4 press conference, said Fr. Anand Muttungal, Public Relations Officer and Spokesperson of the Catholic Church in Madhya Pradesh and Chhattisgarh, in an interview with BosNewsLife. HINDUNESS On the contrary, Dr. Dayal had merely said that Christians in India were against the ideology of Hindutva, on which the RSS is based, Muttungal explained. Hindutva or Hinduness is a word to describe movements advocating Hindu nationalism. The term Hindutva was coined in 1923 by Vinayak Damodar Savarkar a Hindu nationalist whose book, Hindutva, serves as an inspiration for the modern Hindu Nationalistic Movements, according to historians. But we want to tell everyone here that we propagate peace, said Muttungal. The AICU urged the Madhya Pradesh government to end the violence and to restore the confidence and security of the small Christian community in the city. They have a right to burn my effigy if they will, but they no right to wreak vengeance on innocent nuns and priests and common Christian men and women, said Dayal in a statement. In all the last ten years or so, I have never attacked religions. [The AICU] campaign has been against fundamentalism, bigotry and violence... CONCERN There is concern among church leaders that the latest attack is part of a new wave of violence against Christians in the area. Last year on January 11, the Jhabua district of Madhya Pradesh witnessed a spate of anti-Christian violence after the body of a 10-year old girl, who had been raped, was found in a Catholic School. Hindu militants, who alleged the girl had been raped by Christians, attacked churches and Christian institutions as well as houses and other properties of Christians. Police later established that the crime was perpetrated by a Hindu. The state government of Madhya Pradesh is ruled by the pro-Hindu Bharatiya Janata Party (BJP). Christians make up less than one percent of the state's total population of over 60 million, according to government estimates. Film: NCM seeks Minister's intervention By Our Special Correspondent NEW DELHI, FEB. 23. The National Commission for Minorities today urged the Union Minister for Information and Broadcasting, S. Jaipal Reddy, to delay the release of the controversial film, Sins, till the concerns of the Christian community ? which is objecting to certain portions of it ? are addressed. The NCM chairman, Tarlochan Singh, wrote to Mr. Reddy requesting him to stop the release of the film for a few days and get it examined at your level in order to satisfy the sentiments of the Christian minority community. The NCM decided to intervene in the matter after the Archbishop of Delhi, Vincent M. Concessao, lodged a complaint with the Commission about some portions in the film. Mr. Singh said the complaint was that the film hurt the sentiments of Christians. With similar complaints being sent to the Commission against many serials and films by other minority communities, the NCM has decided to meet the Chairperson of the Central Board of Film Certification (CBFC). The NCM, he said, had organised a similar meeting with the then Chairperson of CBFC three years ago and secured an assurance that portions which offended the sentiments of different communities would be deleted. Catholics in Mumbai have over the past week raised objections to film- maker Vinod Pande's `attempt' to sensationalise the so-called fictional sexual escapades of a priest in Sins, due for release on Friday. It was not our intention merely to ban SINS but to convey a strong message to all the so-called neo-Art film makers, including Vinod Pandey who always take us for granted, not to meddle in religion and belittle our cause(s) but to withdraw the film and review the same without the priest and the Cross; not to sell pornography by slighting one community/religion, not to communalise, not to triviliase our contributions to the nation, not to pollute the society at large with amoral values as against moral values taught by Christians and imbibed by Christians and people of other faiths, etc. etc. GL rightly said, But if no one stands-up, then the silence suggest consent, agreement, accord, endorsement. Silence is also considered as one of the deadly sins, which has resulted in amorality on a global scale. Our cause has been duly endorsed by Bishops Bosco, Percy, Agnelo and Cardinal Ivan Dias. We had a protest dharna at Churchgate Station at 5 pm on 23/2, wherein several parish organisations, including organisations of other denominations, clergy, laity, etc. came on a common platform highlighting this issue. Devendra Dwivedi, a former additional solicitor general of India and a senior Congressman, defends his former party colleague and tells Mahendra Ved that Jamir's action is constitutionally correct. How do you defend Governor S C Jamir's actions in Goa? The current controversy regarding Governor Jamir's action in dismissing a government and installing an alternative one is most unfortunate and has trivialised the constitutional discourse. BJP's extreme reaction reflects both ignorance of constitutional issues involved and its track record in denigrating the institutions of democracy, including the office of the governor. Jamir's action is constitutionally correct and in taking the twin action, he has performed his constitutional obligation. His decision reflects no partisanship. What cau-ses me anxiety is that even in the 56th year of our Republic, we find a very low degree of institutionalisation and a near-collapse of a broad, national consensus that the Congress had sought to develop over the years on fundamentals of the Constitution. Did Jamir follow the rule book? What has happened in Goa has to be viewed against the backdrop of the constitutional scheme, the role and place of the governor and his powers under Article 164 of the Constitution, under which he appoints and dismisses governments. The governor, like the president, is the constitutional head who acts on ministerial advice. It is only in the twin situations of a split verdict and the fall of a government that he acts as the reserve gear of the Constitution. Governments are formed on the basis of verdict of the people. But we have adopted the Westminster model under which the constitutional head installs a government in tune with the mandate. The government formation is the exclusive domain of the governor, which is neither subject to judicial review, nor the presidential monitoring, and not even to parliamentary overseeing. His power is unlimited under the Constitution, whose exercise is governed by well-established conventions and practices. Parliamentary system runs on the basis of a body of understanding. It is very distressing that there is an increasing tendency to show disrespect to the sanctity of the decisions of the constitutional functionaries. The framers of the Constitution placed as much faith in the governor in the exercise of power under Article 167 as they did in the Supreme Court in the matter of interpretation of the Constitution. But many said Jamir acted as a Congress rubber stamp? No. Once the BJP-led government in Goa was reduced to minority due to the resignation of BJP MLAs, the governor took the constitutionally correct decision to ask the Parrikar government to test its majority. What happened in the assembly was a subversion of the constitutional scheme. The governor had only two choices: imposition of the President's rule or forming an alternative government. So long as the latter is possible, invoking of the President's rule was constitutionally impermissible. The Congress-led government which was installed, has been, according to conventions, given time to prove its majority. But isn't 30 days too long a time? How much time he gives is the governor's discretion. It is amazing that those who have spent their political lives opposing invoking of Article 356 have suddenly developed fondness for it. Putting the House in suspended animation would have been constitutionally incorrect. What must be mind-boggling is BJP's and particularly Atal Behari Vajpayee's stringent criticism of Governor Jamir's action. Their criticism has denigrated the office of the governor. But this has been their wont; Vajpayee sat on a dharna in Lucknow for the removal of Governor Romesh Bhandari and advocated the constitutionally absurd proposition that the president could remove a governor on his own, without ministerial advice. Then, the Vajpayee government committed a grave constitutional effrontery by removing Fatima Beevi as Tamil Nadu governor on the ground that she had acted on the ministerial advice. So much for Vajpayee's and BJP's respect for the office of the governor and constitutional processes. So, you don't agree with the criticism of Jamir's actions? The Constitution does not envisage a hand-cuffed presidency or governor. Any attempt by any non-constitutional body like political parties or the media to substitute its own judgment with the judgment of the president/governor is to destroy the sanctity of the Constitution and its decision-making process. Indira Gandhi was widely perceived to have misused the governor's office to remove opposition-led governments. Since Rosario could not afford the whole consideration, he requested the landlord to allot him at least 300 sq mtrs now and the rest can be bought later once the funds are available, which was refused and was informed that this plot, consisting of 300 + 100 odd sq. mtrs, has to be bought outright and no partial purchase will be permitted. I guess as per the Mundkar Act, the mundkar has a moral right to purchase from the landlord at least 300 sq. mtrs @ the rate provided by the Govt. authorities. Wud appreciate if anybody can help. We note the attempt to neutralise and demonise activists Ms. Teesta Setalvad and her colleagues who had so far succeeded in convincing the Supreme Court of the grave miscarriage of justice by the High Court and trial courts in Gujarat. They had also exposed the complicity of the police and the political apparatus in the anti-Muslim violence of February-March 2002. We express our solidarity with Ms. Setalvad, Mr. Rais Khan, Fr Cedric Prakash and Mr. Samson Christian, among others, who have been working for communal amity and against religious bigotry in Gujarat. We note the mysterious circumstances in which the young woman Zaheera Sheikh, an eye witness to the arson and murders at the Best Bakery, was whisked away from Mumbai where she as to depose before the court, and brought to Gujarat. Zaheera too remains a victim, who cannot be entrusted to the custody of the Gujarat police and administration. We call upon the Supreme Court and the Central government that she be given adequate security outside Gujarat. The sorry episode speaks of serious lacunae in the criminal justice system. That this is taking place in the backdrop of communal forces of the Sangh Parivar adopting a more strident divisive agenda, adds to the gravity of the situation. We demand of the Central government comprehensive and early legislation to reform the criminal justice system. These reforms must include protection of witnesses on the lines of existing international practices, and laws against hate crimes. By Kumar Chellappan Religious Conversion is back in the news and that too with more vigour. Although religious conversion used to be big news in north India, it was conspicuous by its absence in Kerala. Now conversion news has become as widespread as sex scandals and general hartals. It all started with the attack on the US Missionary Bishop Cooper who while on a visit to Kerala in 2003 got involved in evangelisation work. The Sangh Parivar people attacked him and the poor Missionary left the country in a huff. It is not known whether the Hindu `fundamentalists' lodged any complaints with the local police. These organisations are doing a lot of work for the `uplift' (social and spiritual) of the poor and the downtrodden. There are not many Hindu organisations involved in such projects. I am yet to come across any Hindu organisations or Hindu missionaries who are actively working with lepers, physically and mentally challenged people, HIV + infected people and so on. There are many centres run by nuns and missionaries for terminally ill patients. Orphanages and old age homes managed by the Christian Missionaries offer a lot of relief to all those rejected by their close ones. It need not be a strange coincidence that most of the hospitals, orphanages and educational organisations are run by Christian Missionaries. It requires a lot of money to run these establishments. It is quite natural that foreign agencies offer funds and other aids to these organisations. What is wrong if the Missionaries encourage the poor and the downtrodden to embrace their religion? For the poor, what matters most is two square meals a day. All the governments, which ruled the country for the last sixty years or so, failed miserably in poverty eradication. Although they churn out data and statistics to prove that the number of people below the poverty line has come down, there is no dearth of news about deaths due to starvation and poverty. Even a state like Bengal, which is under a progressive secular regime uninterruptedly for the last 27 years is not free from starvation deaths. Where governments fail, organisations like Missionaries Of Charity emerge, offering food and other benefits. What is wrong if they ask the `unreached' to get converted to their religion? If the Missionaries of Charity or any other organisation is capable of eradicating poverty by making people change their religious belief, they should be encouraged to do so. We now learn that a Saudi Arabian court on 20th October 2004 sentenced Brian O'Connor to 10 months in jail and 300 lashes, accusing him of spreading Christianity and other charges. O'Connor was first arrested on March 25, 2004, by the Muttawa, the Saudi religious police. We learn that the police reportedly tortured the young Indian during his captivity. After enduring months in a Saudi prison, O'Connor was taken to court in late September 2004 for a brief, 90-minute hearing, Charges were reportedly brought against him for selling alcohol and possession of pornography in addition to spreading Christianity. Officers of his employers have declared that the allegations against their employee are not valid, though it is accepted that O'Connor is a practicing Christian. Brian's arrest, his experience in Jail and now the sentence of a jail term and lashing have caused deep concern amongst the Christian Community in India, and the Indian community abroad Indians go to Saudi Arabia and other countries in the Gulf out of desperate poverty and to improve their financial position. Brian has no criminal record at home or abroad, and has been arrested, we feel, just for his religious convictions. We appeal to the government of India to urgently intercede with the Government of Saudi Arabia for the immediate release of an Indian citizen. We also appeal to His Majesty the King of Saudi Arabia to generously give clemency to O'Connor, and ask his government to release this Indian citizen who has already suffered much. I guess we have to assert ourselves and be pro-active in terms of putting our protests across and that can be achieved if the media and ofcourse the police heirarchy are flooded with letters from likeminded citizens voicing their protests rather than cursing the administration within the 4 walls and in the markets. I believe that all of us want to reach out and help to fight injustice. If push come to shove, I would come down from my cozy nook and high horse on to the street and I am sure the like-minded citizens will join me and other social activists in solidarity. Our objective is to strengthen, synergise and compliment our thoughts and protests graciously, so that together we can curtail/stop all this bullying and justice meted out. In the meantime, I appeal to those who hold the reins of power to desist from misusing their power to victimize innocent citizens.
